Acceptable Use Policy

1. About This Policy
OrqestraX is a B2B operations and compliance platform operated by Orqestra LLC. It connects state-licensed operators — producers, manufacturers, retail operators, brokers, and couriers — so they can conduct operator-to-operator wholesale business in regulated industries. It is not a consumer marketplace.
This Acceptable Use Policy ("AUP") is the rulebook for that platform. It applies to everyone with an OrqestraX account and is part of, and incorporated into, our Terms of Service. By using OrqestraX you agree to follow it. Orqestra currently operates in New Mexico only.
2. Our Role
Orqestra is an ancillary technology provider. We provide the software that operators use to find counterparties, transact, and stay compliant. We are not a party to any transaction between operators, we never take title to or take possession of any product, and we do not provide legal advice. You are responsible for the lawfulness of your own activity and for your own compliance with state law and regulator requirements.
3. Who May Use the Platform
Access to OrqestraX is limited to verified, state-licensed operators in good standing. To use the platform you must:
- Hold every license required for the activity you conduct on the platform, current and valid under the law of the state in which you operate.
- Provide accurate license, identity, and tracking information at signup, and keep it accurate and up to date.
- Use the platform only for lawful operator-to-operator business — transactions between licensed operators in products that are lawful under state law but restricted under federal law.
- Comply with all applicable state laws, regulations, and recordkeeping, manifest, and chain-of-custody requirements that govern your activity.
4. Prohibited Conduct
You may not do any of the following on or through OrqestraX. This list is not exhaustive — anything unlawful, or that undermines the integrity of the platform, is prohibited even if it is not named here.
Licensing and identity
- Using the platform without holding a valid, required license for the activity you are conducting.
- Misrepresenting your license status, license type, identity, business, or authorization to act for a licensed operator.
- Letting an unlicensed person or business use your account, or accessing the platform on behalf of an unlicensed party.
Sales and transfers
- Selling, transferring, or arranging delivery of any regulated or controlled product to an end consumer, to the general public, or to any unlicensed party.
- Using the platform for any transaction that is not a lawful transfer between licensed operators.
Compliance and recordkeeping
- Uploading false, altered, or misleading license documents, lab or certificate-of-analysis (COA) files, manifests, delivery-proof photos, or other records.
- Circumventing, defeating, or falsifying compliance, manifest, tracking, or chain-of-custody requirements — including moving product outside the documented, tracked process.
- Misrepresenting the nature, quantity, origin, or testing status of any product or listing.
Payments and fraud
- Fraud of any kind, including payment fraud, identity fraud, or knowingly providing false information.
- Abusing chargebacks or payment disputes, or filing claims in bad faith.
- Circumventing the platform's payment process to avoid fees, recordkeeping, or compliance — for example, arranging the transaction on OrqestraX and settling off-platform to evade tracking.
Platform integrity and security
- Scraping, crawling, or otherwise harvesting data from the platform through automated means without our written permission.
- Harassing, threatening, defaming, or abusing other operators, couriers, or our staff.
- Probing, scanning, or testing the security of the platform; attempting to gain unauthorized access to any account, system, or data; or interfering with the platform's normal operation.
- Introducing malware, or using the platform to distribute spam or unlawful content.
5. Reporting Violations
If you believe an operator or account is violating this policy, report it to info@orqestrax.com with as much detail as you can. We review reports we receive, and we may also detect violations through our own monitoring and compliance checks.
6. Enforcement
When we identify a possible violation, an Orqestra administrator reviews it. There is no fixed number of warnings or strikes. Depending on the severity, the facts, and the history of the account, we may, at our discretion and without prior notice, take any of the following actions:
- Issue a warning and ask you to correct the problem.
- Remove or restrict specific content, listings, or features.
- Suspend your account, setting its status to suspended while we investigate or pending correction.
- Terminate your account, setting its status to banned, which ends your access to the platform.
An account in good standing is active. Serious or repeated violations, fraud, and unlawful activity can lead directly to termination without an intermediate step. We may also withhold or reverse funds connected to a transaction we reasonably believe is fraudulent or unlawful.
7. Cooperation With Regulators and Law Enforcement
Orqestra operates in a regulated environment. Where we reasonably believe activity on the platform is unlawful, or where we are legally required to do so, we may report that activity, and share related records, with the appropriate state regulators or law enforcement. We may also cooperate with valid legal requests. This is consistent with our Privacy Policy.
8. Changes to This Policy
We may update this Acceptable Use Policy as the platform, our practices, or the law change. Material changes will be reflected in the "Last updated" date above, and your continued use of the platform after a change takes effect means you accept the updated policy.
